Our Website Privacy notice is intended to inform you of how we use the information that you provide. In order to sustain our business and provide products and services, it is essential that we collect certain information about our customers and members. The information that we collect informs our business planning and allows us to provide services and products that are tailored to meet the requirements of the site users/customers.

We have appointed Maria Marraffa as our lead Data Protection Officer. They have overall responsibility for monitoring this privacy notice and to ensure effective implementation.

All online transactions are processed through a gateway provider (PayPal & Stripe) and are not stored or processed on our servers. 2.1 Training 4 Early Years is a provider of a Learning Managment System (LMS); stand-a-lone e-learning courses, bespoke e-learning courses; online learning subscriptions, training provider.  These are known as the ‘Service’ or ‘Services.’
 
2.2 We reserve the right to change pricing and availability in respect of any of the Services in this clause for any reason and without notice.
 
2.3 Training 4 Early Years is not responsible for non-delivery or technical limitations of the end user for any reason in respect of any of the Services in this clause.  You are strongly advised to contact us should you have any difficulty in this respect.
 
 
3.  Personal Details
3.1 Certain aspects of the services may require you to register and provide information about yourself.  You agree to: (a) provide true, accurate, current and complete information about Yourself and any company that You represent as prompted by the relevant forms and requests, and (b) maintain and promptly update Your information (by emailing Us or maintaining any forum or associated member information) to keep it true, accurate, current and complete and We shall not be liable for any loss suffered by Your non-compliance with this provision.

4.6 You acknowledge that Training 4 Early Years does not pre-screen Content that You post on the Website or related social media platforms, but understand that Training 4 Early Years and people designated by it shall have the right (but not obligation) to monitor communications that occur through, and posts made to, the Website or its related social media platforms.  If Training 4 Early Years determine, in its sole discretion, that You or another user has breached these Terms And Conditions or that any Content on its Website or related social media platforms is inappropriate or otherwise objectionable, Training 4 Early Years may refuse to accept or may remove any Content from the Website, without any liability to You or a third party.
 
 
5.  Indemnity

20.  Events Beyond Training 4 Early Years’ Control

20.1.7 Viruses and cyber attacks; and/or
20.1.8 Power or other failure affecting any part of Our servers, premises or any other part of Our service.
20.2 Training 4 Early Years’s performance under any Terms And Conditions or any Contract is deemed to be suspended for the period that the Force Majeure Event continues, and We will have an extension of time for performance during that period.  We will use Our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which Our obligations under the Terms And Conditions or any Contract may be performed despite the Force Majeure Event.
 
 
21.  e-Learning courses
21.1 The product and resources Services in Training 4 Early Years’ allow You to purchase courses directly from the Website.
 21.2 You need to have a free Training 4 Early Years account to purchase courses as that is the way this LMS works.
 21.3 When You create an account You will need to supply Us with compulsory personal information and You confirm that all information and details You have provided are true, accurate and up-to-date in all respects.  Please see Our Privacy Policy for more information.
 21.4 Training 4 Early Years will use reasonable endeavours to try to ensure that products and Services have been fairly described.  
 21.5 Training 4 Early Years aims to regularly update the Website.  Products, Services and prices are subject to change without notice but these changes will not affect orders which We have already processed.
 21.6 The price of a product does include VAT in accordance with UK tax directives.
 21.7 If We become aware of an error in pricing We will inform You of this error and give You the option of continuing to purchase the items at the correct price or cancelling Your order.

21.8 Training 4 Early Years will not be held responsible for pricing errors due to software malfunctions, or human error.  Where an error is obviously a mistake which could reasonably have been recognised by You as a mispricing We will not be obliged to provide the course to You at the price stated.

21.9 During the checkout process You will be asked to enter Your payment details.  By doing so, You confirm that the credit or debit card being used is Yours, or You have the full right to use it.
 21.10 You will be only permitted to pay for products using a debit or credit card through a secure payment gateway (Stripe/PayPal).

21.11 Invoice arrangements must be agreed beforehand, and will be considered on a case-by-case basis.

21.12 All invoiced products and Services must be paid for within fifteen days and specific terms will apply.  
 21.13 Invoices can be paid via bank transfer, cheque of card
 21.14 All transactions will be carried out in Pounds Sterling.
 21.15 Training 4 Early Years reserves the right to decline orders for bulk or high value purchases.  If You wish to purchase a large number of courses please contact Us prior to purchase.
 21.16 Should You use any of the resources included with a course within Your business, You agree that You will use the them in Your own business only and that You will not use the products for any re-sale or prohibited purposes as specified in clause 4.5 or otherwise.
 21.17 If the courses(s) provided is/are not what You ordered, We shall have no liability to You unless You notify Us in writing at Our contact address of the problem within five working days of the delivery of the Service in question.
 21.18 Save as precluded by law, We will not be liable to You for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem You notify to Us under this contract and We shall have no liability to pay any money to You by way of compensation other than to refund to You the amount paid by You for the relevant order.
 21.19 You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase the Services from Our Website.  The importation or exportation of certain goods may be prohibited by certain national laws.  We make no representation and accept no liability in respect of the export or import of the products under the Service You purchase.
  
22.  Your Right To Cancel 

22.1 It is important to us that you are able to access the training that you need and we understand that sometimes things crop up or circumstances change.  

22.2 If you need to cancel your training, please contact us at contact@training4earlyyears.co.uk or telephone 01282 550215.

22.3 We can only offer a refund in the following circumstances:

  • e-learning - if you have not accessed and completed any of the course that you have purchased.
  • webinar - it must be more than 48 hours before the course.
  • face to face course - it must be more than 5 days before the course.
  • Blended Paediatric First Aid Level 3 - it must be more than 5 days before the face to face part of the course.

22.4 We do not offer refunds on subscriptions.

22.5 Refunds will be issued to the original payment method used at the time of purchase.  Please allow 5 days for the refund to occur.  If you have not recieved the refund in that time, please contact us.

22.6 In the case of training it is Your responsibility to ensure that the course You have ordered meets Your needs because once You have requested the course, You will not be entitled to a refund.

22.7  We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by You.  You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

24.  Purchase Liabilities
24.1 Nothing in these Terms And Conditions limits or excludes Our liability to You for death or personal injury caused by Our negligence, fraud or fraudulent misrepresentation or breach of statutory terms or terms implied by law.
 
24.2 If You purchase items or a Service for business purposes, We will not be liable to You for any loss of profits, sales, business or goodwill or any indirect or consequential loss or any loss which was not foreseeable at the time of the sale of the product/Service and Our total liability to You in respect of all other losses arising under or in connection with Your purchase of the product/Service shall in no circumstances exceed 100% if the total price of the product/Service.
 
24.3 We do not give any representation, warranty or undertaking in relation to the products other than as stated.
 
24.4 We will not be liable for any failure to perform, or delay in performance, of any of Our obligations which is caused by an event outside Our control, such as civil commotion, storm, fire, natural disaster or the failure of telecommunications or transport networks.  If We are affected by such an event, We will notify You as soon as reasonably possible and Our obligations to You will be suspended until We are no longer affected by that event when We will arrange an alternative delivery date with You.
 
24.5 We may update or amend these Terms Of Sale from time-to-time to comply with law or to meet Our changing business requirements without notice to You.  Any updates or amendments will be posted on the Website.
 
24.6 No relaxation or delay by Us in exercising any right or remedy under these Terms And Conditions of Sale shall operate as waiver of that right or remedy or shall affect Our ability to subsequently exercise that right or remedy. Any waiver must be agreed by us in writing.
 
24.7 If any of these General Terms And Conditions Of Sale are found to be illegal, invalid or unenforceable by any court of competent jurisdiction, the rest of these General Terms And Conditions of Sale shall remain in full force and effect.

25.  Products Created Together
25.1 Training 4 Early Years provides a Service for the joint creation of courses either by You offering a suggestion or You providing more guidance upon which Our developers produce a course.  This Service is subject to these Terms And Conditions and in an addition the following conditions shall apply to this Service:
25.1.1 Training 4 Early Years will work with You upon payment of a fee as agreed.
25.1.2 In accordance with the general Terms And Conditions, should there be any account username and password associated with this Service, they will not be shared.
25.1.3 Your collaboration is a request by You, to Us, to create a specified resource for You.  We may perform the whole request unaided by You, or You may also assist Us.  In this regard, You understand that by working with us in any way, You are producing courses for Training 4 Early Years and not for Your own personal use.  Once Your course has been created, We may, at our discretion, allow You to access the resource after our approval.
25.1.4 In accordance with Our Copyright Terms below, You will not redistribute any resources created with us unless agreed.
25.1.5 You have explicitly read and agree to abide by the Training 4 Early Years’ Copyright Terms (section 26.)
25.1.6 All resources We produce with You are the ownership of Training 4 Early Years absolutely and You further consent to Clause 7.2 of these Terms And Conditions.
25.1.7 You agree that a breach of any of the general Terms And Conditions will lead to Your access to the creation and any other Training 4 Early Years’ Service being immediately suspended.  It is at Our absolute discretion as to whether Your account and/or relationship with Us will be reinstated.
25.1.8 You understand and agree that We will monitor Your usage of the creation Service to allow Us to determine whether a violation has, or is, occurring.
25.1.9 Due to the bespoke element of the creation Service, You understand and agree that We are unable to offer refunds under any circumstance.
